VISTO DE TRABALHO PARA CÔNJUGES

Mudanças no Visto de Trabalho para membros familiares de Residentes Temporários

A imigração anunciou mudanças na elegibilidade do Visto de Trabalho para cônjuges de estudantes internacionais.

A partir do dia 21 de janeiro de 2025, só obterá o Visto de Trabalho Aberto (Open Work Permit) apenas cônjuges de estudantes internacionais matriculados em:

  • Programas de mestrado com duração de 16 meses;
  • Programa de doutorado;
  • Profissionais selecionados e programas elegíveis.

Open Work Permit para cônjuges

O visto de trabalho aberto será limitado a cônjuges de trabalhadores estrangeiros empregados em:

  • Ocupações TEER 0 ou 1;
  • TEER 2 ou 3 em setores com escassez de mão de obra como em setores da construção, assistência médica, setores militares entre outros.

Regras para o OWP – Visto de Trabalho

Segundo as novas regras para o Open Work Permit, o trabalhador estrangeiro deve ter pelo menos 16 meses restantes na autorização de trabalho, no momento em que o cônjuge solicitar o OWP.

Filhos dependentes de trabalhadores estrangeiros não estão mais elegíveis.

Os vistos de trabalho aberto já emitidos e que não expiraram, continuam válidos.

Elegibilidade

A elegibilidade para o Visto de Trabalho familiar depende de:

  • O tipo de trabalhador o aplicante é no Canadá
  • Se o aplicante já está em um caminho ou já solicitou residência permanente

O trabalhador se torna elegível ao visto para o membro familiar se já solicitou a residência permanente por meio de um programa ou piloto de imigração econômica como os listados abaixo:

-Agri-Food Pilot
-Atlantic Immigration Program
-Canadian experience class
-Caring for children class or caring for people with high medical needs class
-Federal skilled trades class
-Federal skilled worker class
-Holders of a Quebec Selection Certificate (CSQ) who applied for PR including:
Quebec skilled worker class
Quebec investors program
-Home Child-Care Provider Pilot and Home Support Worker Pilot – Direct to PR stream
-Provincial Nominee Program
-Rural and Northern Immigration Pilot Program
-Start-up business class

Para obtenção do Visto de Trabalho para o cônjuge em 2025, deve-se atender a 3 requisitos:

  1. 1. Devem atender aos requisitos gerais de elegibilidade para uma autorização de trabalho no país.

  1. 2. Ter um relacionamento genuíno com o candidato principal sendo:
    a)seu cônjuge ou companheiro(a)
    b)um filho dependente seu ou do seu cônjuge
    c)Um filho dependente não pode ser o requerente principal.
    d)o filho dependente do seu filho dependente (seu neto ou neto do seu cônjuge)

  1. 3. Se o seu familiar estiver no Canadá, ele deverá estar em uma das seguintes situações:

a) Ter status de residente temporário válido.
b) Ter solicitado a extensão do status antes que ele expirasse (maintained status).
c) Eles são elegíveis para a restauração do seu status de: Visitante, trabalhador ou estudante.

Se o seu familiar não for elegível para solicitar uma autorização de trabalho aberta, ele pode ser elegível para solicitar outra autorização de trabalho . Se ele não planeja trabalhar, ele pode ser elegível para visitar ou estudar .
